Dreamwell Terms of Service

Welcome to Dreamwell, operated by Ethereal Music Group Ltd. (“Dreamwell,” “we,” “us,” or “our”). These Terms of Service (“Terms”) explain your rights and responsibilities when using the Dreamwell mobile application, website, and related services (collectively, the “Services”).

By downloading, accessing, or using Dreamwell, you agree to these Terms. If you do not agree, please do not use the Services.

The Services are operated by Dreamwell, a company incorporated in British Columbia, Canada.

References to “Dreamwell” or “App” include all versions of the mobile application, related websites, features, updates, and digital content.

2. Eligibility and Account Terms

• You must be at least 16 years old (or the local age of digital consent) to use Dreamwell.

• If you are under the age of majority in your jurisdiction, you must have parental or legal guardian consent.

• You are responsible for maintaining the confidentiality of your credentials and all activity under your account.

• We may suspend or terminate accounts that violate these Terms or misuse the Services.

3. User Obligations and Acceptable Use

You agree to use Dreamwell only for lawful purposes. You may not:

5. Health Disclaimer

Dreamwell supports healthy sleep and relaxation habits, but:

• It is not a medical device or diagnostic tool.

• It does not replace medical advice or treatment.

• Results and experiences may vary from person to person.

If you have a sleep disorder, anxiety, depression, or other medical concerns, consult a qualified healthcare provider before using the App.

Do not use Dreamwell while driving or operating machinery.

6. Subscriptions and Payments

Dreamwell may offer free content, trials, or paid subscriptions through Apple App Store, Google Play, or other approved platforms.

• Pricing and Renewal: Prices and renewal terms are displayed during checkout. Subscriptions automatically renew unless cancelled at least 24 hours before renewal.

• Managing Subscriptions: You can cancel or modify your plan in your app store account settings.

• Refunds: All billing and refunds are handled by the app store provider, not Dreamwell.

• Taxes: Prices may include applicable taxes, depending on your region.

• Is defamatory, hateful, or harassing;

• Contains malware, spam, or harmful code.

Dreamwell is provided “as is” and “as available” without warranties of any kind.

We do not guarantee that the App will be uninterrupted, error-free, or achieve specific results.

To the fullest extent permitted by law, Dreamwell and its affiliates will not be liable for indirect, incidental, or consequential damages arising from use of the Services.

Nothing in these Terms limits rights that cannot be excluded under Canadian, U.S., or EU consumer-protection laws.

12. Indemnification

You agree to indemnify and hold harmless Dreamwell, its officers, directors, employees, and partners from any claims, damages, or expenses (including legal fees) arising from:

• Your use or misuse of Dreamwell;

• Infringement of third-party rights.

13. Dispute Resolution and Governing Law

These Terms are governed by the laws of British Columbia, Canada, without regard to conflict-of-law rules.

Any dispute must be filed in the courts of Vancouver, BC.

For international users, Dreamwell may offer binding arbitration (where permitted by law) as an alternative to court proceedings, conducted in English under the rules of the Canadian Arbitration Association.

All communications, including notices, will be in English.
